1. Acceptance and services

By using Longevity Labs, you agree to the Terms of Service. Longevity Labs is an educational health platform that provides biomarker explanations, health document storage, AI-assisted summaries, a curated test catalogue, and optional access to independent practitioners.

The platform is not a healthcare provider and does not provide medical care, diagnosis, treatment, prescriptions, or emergency services.

2. Eligibility and account security

You must be at least 18 years old and legally capable of entering into these Terms to create an account or begin onboarding. You are responsible for providing accurate and complete information, keeping your account credentials secure, and notifying us promptly if you suspect unauthorised access.

You may not share your account, impersonate another person, submit information you do not have authority to provide, or use the platform for unlawful, abusive, fraudulent, clinical emergency, or high-risk medical purposes.

3. Medical disclaimer

Longevity Labs is not a substitute for professional medical advice, diagnosis, or treatment. Our platform provides health insights for informational and educational purposes only. Longevity Labs and its digital tools do not provide medical services that require registration under the Health Practitioners Competence Assurance Act 2003 (New Zealand), the Health Practitioner Regulation National Law (Australia), or equivalent professional regulation.

Our health assistants do not diagnose medical conditions, prescribe medication, provide treatment plans, provide specific dosage recommendations, or replace the advice of registered health practitioners. Always consult a qualified healthcare provider before making changes to medication, treatment, supplements, diet, exercise, or any other health routine. If you have urgent symptoms or a medical emergency, call 111 in New Zealand, 000 in Australia, or your local emergency number immediately.

4. User obligations and payments

You agree to provide accurate information, maintain account security, use the platform lawfully, avoid sharing your account, report security concerns, and seek professional advice for health concerns.

Paid services are processed securely through Stripe. Refunds and test-kit handling are subject to the Terms of Service and applicable non-excludable consumer rights.

5. Liability waiver and ordinary risks

Before beginning onboarding, you must also accept the Liability Waiver and Assumption of Risk. That waiver explains ordinary risks associated with educational wellness information, biomarker interpretation, AI-generated summaries, optional tests, wearable data, uploaded documents, and third-party services.

You agree not to delay or avoid professional medical care because of information shown by Longevity Labs. You remain responsible for deciding whether and how to discuss platform information with a qualified healthcare professional.

6. Intellectual property

All content, features, software, design elements, trademarks, and functionality of Longevity Labs are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may use the platform for your personal, lawful use only. You may not copy, scrape, reproduce, distribute, modify, reverse engineer, or create derivative works from the platform except as permitted by law or with our written permission.

7. Privacy and health information

Use of Longevity Labs is governed by the Privacy Policy. Health information is sensitive information. We collect and process health information only as described in the Privacy Policy, with your consent where required, and for purposes connected with providing and improving the platform, processing orders, supporting optional practitioner access, and complying with legal obligations.

You may withdraw consent for certain processing or sharing activities as described in the Privacy Policy, but withdrawal may limit or prevent access to features that require that information.

8. Limitation of liability

To the maximum extent permitted by law, Longevity Labs is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss arising from your reliance on educational information without appropriate professional review.

Nothing in these Terms or the Liability Waiver excludes, restricts, or limits liability or rights that cannot legally be excluded, restricted, or limited. This includes non-excludable rights under the Consumer Guarantees Act 1993 (New Zealand), Australian Consumer Law, and other applicable consumer-protection laws.

9. Changes, suspension, and termination

We may update these Terms from time to time. If a change is material, we will take reasonable steps to notify you, such as by posting the updated terms, emailing you, or requiring renewed acceptance before continued use of affected features.

We may suspend or terminate access where reasonably necessary to protect users, comply with law, prevent misuse, investigate security issues, or enforce these Terms.

10. Governing law

These Terms are governed by New Zealand law, subject to non-excludable consumer rights and mandatory laws that may apply in your location. Any disputes arising from these Terms or your use of the platform are subject to the courts of New Zealand unless applicable law requires otherwise.

For users in Australia, nothing in these Terms excludes, restricts, or modifies consumer rights under Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
